Detroit Mayor Mike Duggan’s announced this evening during his State of the City Address that he would urge Lansing lawmakers to support major reforms to Michigan’s auto insurance system. In response to Mayor Duggan’s comments, the Coalition Protecting Auto No-Fault (CPAN) President John Cornack issued the following statement: “We agree that Detroiters are paying far too much for auto insurance. However, to blame Michigan’s no-fault system is completely misleading.

CPAN is urging all members to CALL their Michigan lawmakers today and tell them to vote NO on the proposed last-minute Lame Duck no-fault legislation. The Michigan Legislature are considering a last-minute bill today that would drastically impact the state’s no-fault auto injury system while benefitting insurance companies.

Our friends at the Brain Injury Association of Michigan said in a recent Facebook post, “lame duck session is coming and is scarier than Halloween.” Unfortunately, this year, that’s turning out to be true. Late last week, Representative Jason Sheppard, R-Temperance, introduced legislation — HB 5951 — that once again puts Michigan’s no-fault system and its critical medical benefits at grave risk. The bill proposes different levels of medical benefits, starting at an abysmal $250,000 cap on medical coverage. This would leave accident victims with limited coverage and zero options.

On June 22, 2016, the Michigan Supreme Court granted CPAN’s Motion for Leave to File an Amicus Brief in the case of Covenant Medical Center, Inc. v State Farm, which is currently pending in the Michigan Supreme Court (Docket No. 152758). CPAN’s General Counsel, George T. Sinas, of the Sinas Dramis Law Firm, drafted and filed CPAN’s Motion seeking amicus status and, in a recent statement, emphasized the significance of this case. The Michigan No-Fault System Is Under Attack!

The insurance industry has introduced legislation that, if enacted, would fundamentally change the basic nature of the Michigan auto no-fault system.

Michigan insurance companies want to cap your injury and rehabilitation auto insurance benefits (known as Personal Injury Protection), which they say will save drivers about $10 per month for one year.  

Here’s what insurance companies are not telling you about this legislation:

  • The insurance industry-backed legislation will result in little savings -- just $10 per month for ONE YEAR ONLY. After that, there are no guarantees of long-term savings. 
  • Drivers will have to purchase MORE insurance to protect themselves from underinsured drivers.
  • Seriously injured drivers will be FORCED onto welfare programs to pay for their care once their auto insurance hits the proposed limits, costing taxpayers tens of millions of dollars each year.
